Emergency and Routine Repairs in a Rental

Queensland's tenancy law sorts every repair on a rental into two types: emergency repairs and routine repairs. The Act's emergency list names the plumbing and gas faults:

  • a burst water service, or a serious leak on the water service
  • a loo blocked or broken
  • a gas leak
  • a failure or breakdown of the gas or water supply
  • a breakdown of an essential appliance for hot water, heating or cooking

Faults likely to injure someone, or that leave the premises unsafe or insecure, count as emergencies too. So do repairs needed to bring a rental up to the minimum housing standards.

Everything else is routine. The tenant reports it to the manager or owner, and the repair then needs to happen within a reasonable time. The tenancy agreement also does two jobs here: it names the nominated repairer with their phone number, and it says who the tenant contacts first.

If that contact cannot be reached within a reasonable timeframe, the tenant or the manager may arrange a suitably qualified person, up to a limit of 4 weeks' rent. A verbal report is enough to set that in motion.

Repairs on a rental are licensed work. Unblocking sanitary pipework, mending broken pipes and replacing a fitting or fixture all take a licensee, with none of it needing registration. Notifiable work is different: the plumber lodges a Form 4 with the QBCC, and the owner or the agent receives the copy. Gas work has its own paperwork, which our gas compliance certificates page covers.

Flow and Flush Limits Behind Tenant Water Bills

A Queensland rental counts as water efficient when its indoor cold taps and showerheads run at no more than 9 litres per minute and its toilets meet the flush limits. The test in full:

  • every internal cold tap over a basin, sink or laundry trough, single mixers included, and every showerhead: 9 litres per minute at most
  • toilets: dual flush, with a full flush of 6.5 litres or less, a half flush of 3.5 litres or less
  • the average flush, worked out from one full flush and four half flushes: 4 litres or less

Not every tap counts. Bathtub taps, outdoor garden taps and taps that feed washing machines, dishwashers and other appliances sit outside the test. On guidance from the Residential Tenancies Authority, fixtures made from 2005 onwards should carry a Water Efficiency Labelling and Standards (WELS) rating of 3 stars or higher, though that is guidance rather than law.

What a Rental Water Efficiency Check Covers

A water efficiency check is a plumber measuring every indoor cold tap, mixer, showerhead and toilet against the rental limits and noting any fixture that falls short. Each fixture carries a WELS label showing its star rating and water use, so the plumber reads the label rather than guessing.

Fixtures that fail are replacement jobs. Swapping a tap or a toilet is regulated work for a licensed plumber, while a shower head swap is unregulated and anyone may do it, provided the new head still meets the standard. Our toilet installation page covers the suites that pass the flush test.

One thing the check is not: a certificate. We set out what we measured and what we found, and we do not sell a report, sign-off or compliance document as a deliverable.

Passing a Water Bill On to a Tenant

An owner or manager can bill a tenant for the whole water account only when every one of these conditions is met:

  • the property is individually metered, or its water is delivered by vehicle
  • the property passes the water efficiency test
  • the agreement states that the tenant pays for water
  • the tenant receives a copy of the bill within 4 weeks of the owner or manager receiving it

Two 4 week deadlines then run. The owner or manager has 4 weeks from receiving the bill to hand over a copy, and a bill that arrives late does not have to be paid. The tenant then has 4 weeks from receiving that copy to pay.

Not everything on the bill travels. The State bulk water charge and the usage charges can be passed on once the conditions are met. The sewerage usage charge and the fixed water and sewerage access charges stay with the owner or manager.

Where a rental fails the efficiency test, the owner or manager pays a reasonable amount of water and may ask the tenant for the excess only. The Act leaves "reasonable amount" to be agreed as a special term in the agreement. Water lost to a hidden supply leak also skews any account, so leak detection is worth running before a dispute starts over usage.

Rentals Make Up Most of Albion

At the last census, flats and apartments made up 1,243 of the suburb's 1,677 dwellings, against 372 separate houses. Most plumbing calls here come from owners and managers of unit blocks off Albion Road and the older cottages behind Sandgate Road, rather than from the people living in them.

Access follows from that. A repair visit needs entry to a home the tenant controls day to day, so the time and the way in are settled with the tenant through the owner or manager before the plumber attends.

How a Rental Repair Visit Runs

  1. 1

    Describe the problem

Phone (07) 3523 7172 or fill in the form with what you're seeing in Albion. The more we know, the better we can prepare.

  2. 2

    Attend and sort the fault

We attend the address, trace the fault on site and explain what it means in rental terms: emergency, routine or notifiable. Anything urgent gets treated first, and the visit is arranged around the tenant's access.

  3. 3

    Agree on the price

A fixed quote comes before any work starts: flat-rate pricing, no hidden fees, and your go-ahead first.

  4. 4

    Pay on completion

Card or EFTPOS on site when everything's working, or ask us about Fix now, pay later.

Rental Plumbing Questions From Albion

Call (07) 3523 7172

What flush volumes must a rental toilet in Albion meet?

Dual flush only. The full flush is 6.5 litres or less, the half flush 3.5 litres or less, and the average, taken from one full flush and four half flushes, 4 litres or less. Those volumes form part of the test for billing a tenant for the whole water account.

Is a tenant billed for all the water used?

No, only when four conditions are met. The property is individually metered and water efficient, the agreement says the tenant pays, and the tenant gets a copy of the bill within 4 weeks of the owner receiving it. The sewerage usage charge and fixed access charges stay with the owner.

When must an Albion owner give a tenant the water bill?

Within 4 weeks of receiving it from Urban Utilities. Miss that deadline and the tenant does not have to pay that bill. A tenant who gets the copy in time then has 4 weeks from that date to pay it.

What does a water efficiency check involve?

A licensed plumber compares every indoor cold tap, mixer, showerhead and toilet in the Albion rental with the limits, reads each fixture's WELS label and notes any that fall short. Failing taps and toilets are then replaced by a licensed plumber. No certificate, report or sign-off is promised as part of the check.

Who receives the Form 4 for plumbing work on a rental?

For notifiable work, the licensee lodges the Form 4 with the QBCC within 10 business days of finishing. Whoever engaged the plumber receives a copy, often the agent. Minor work, such as mending a broken pipe or swapping a fixture, needs nothing registered.
